IP BYTES: India's first IP sensitization program for software/IT industry
India being IT/ software and process outsourcing hub has emerged as a preferred destination for outsourcing software development services. The spot-light of the industry is primarily on the service model which is in some way refraining IT companies from creating products using their own Intellect. Most of the service oriented IT firms derive major part of their business from R&D firms; and are contractually bound not to own IPRs even on products/solutions they have developed. However, product development is slowly rising in India. Also, many innovations in processes are happening in many firms constantly. While businesses recognize the importance of innovations to sustain in business, firms seldom understand the need for IPR. According to Sabapathy, COO, Cymfony, "IPR as a topic is not given its due importance and is assessed only in terms of number of patent applications filed, even though the meaning and implications of the subject goes much beyond it. Data security and Confidentiality are one of the prime concerns in outsourcing model, often secured by means of agreement but practically vendor finds it extremely difficult to safeguard the same specifically when employee attrition is high and awareness level is low. In fact every industry today is facing a tough challenge to protect confidential information, know-how and trade secret", says Saba Another important aspect of IP is that more than protection of proprietary intellectual property, it is imperative to be aware of usage of intellectual property of third party, with or without knowledge. Process (s) within organization should have best IP practices to integrate security and confidentiality of information whether it is a product or service based industry. According to Dr S Rama Murthy, Professor & Head, Knowledge Management, Centre for Emerging Technologies, Jain University, Bangalore and scientific advisor to Indian Patent Office says that, "Presently there is no specific program or training in India to address specific issues of the industry and I feel such a program will make lots of business sense to the industry. Sensitization for IP would fetch more confidence from the clients, ensure disclosure of ideas from employees, make them understand their liabilities and create a conducive environment for innovation".
