PCT National Phase Filing
India became member of PCT (Patent Corporation Treaty) on December 7, 1998 and is also a signatory to GATT (General Agreement on Tariffs and Trade). National phase entry to India can be made through the PCT route, if India is selcted as a Designated Country by the applicant. In India a National Phase patent application can be filed within 31 months from the priority date whereas a Conventional Applications can be filed within 12 months of priority date.
